3. Quotes and Fees

Quotes provided by us are valid for 30 days from the date of issue unless otherwise stated in writing. All fees are quoted in Australian dollars (AUD) and may be subject to GST where applicable. Payment terms will be specified in the applicable proposal or service agreement. Late payments may attract interest and reasonable recovery costs as permitted by law.

4. Client Responsibilities

You agree to provide accurate, complete, and timely information and documentation reasonably required for us to perform the services. Delays caused by incomplete or late information may affect agreed timelines and may result in additional fees.

5. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted, or modified. Our services come with guarantees under the Australian Consumer Law that cannot be excluded, including guarantees as to due care and skill.

6. Intellectual Property

All content on this website, including text, graphics, logos, and design, is owned by or licensed to Tb Consultancy Services Pty Ltd and protected by Australian and international intellectual property laws. Upon full payment, deliverables produced specifically for you under an engagement will be assigned to you as set out in the applicable service agreement, unless otherwise agreed. Pre-existing materials, methodologies, and templates remain our property.

7. Confidentiality

Both parties agree to keep confidential all non-public information disclosed during an engagement and to use such information solely for the purpose of providing or receiving the services. This obligation survives termination of the engagement.

8. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for indirect, incidental, special, or consequential loss, including loss of profits, revenue, or data. Our total aggregate liability for any claim arising from the services is limited to the fees paid by you for the specific service giving rise to the claim, except where such limitation is not permitted by the Australian Consumer Law or other applicable law.

Upon termination, you remain liable for fees for services performed up to the date of termination.

These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

We may update these Terms from time to time by publishing a revised version on this page. Continued use of the website or engagement of our services after publication constitutes acceptance of the revised Terms.
